Assets of Community Value

Supporting our Local Pubs!

Assets of Community Value (ACV) is a designation used in the United Kingdom under the Localism Act 2011. The purpose of ACV is to give local communities the opportunity to identify and protect assets that are considered important to their social well-being and cultural interests. When a property or land is listed as an ACV, it means that the community has the right to bid for it if it comes up for sale.

If you love your local pub and think it adds value to your local community, then why not list it as an Asset of Community Value? A listing can be applied for through your local council. Since 2012 community groups across England have listed thousands of pubs this way. This means that if the pub comes up for sale as a development opportunity, the community will be notified and given the first opportunity to bid to buy the pub.

Here are some key points about Assets of Community Value:

1. Definition and Purpose:
• An asset of community value is defined as a building or other land that has a significant value to the local community’s social well-being or social interest.
• The purpose is to empower local communities to have a say in the use and future of important local assets.

2. Listing Process:
• Local community groups, including parish councils and community organizations, can nominate assets to be listed as ACVs.
• Local authorities assess nominations and decide whether the suggested asset meets the criteria for listing.

3. Criteria for Listing:
• The asset must contribute to the community’s social well-being or social interests, including cultural, recreational, or sporting interests.
• The use of the asset furthers the social well-being or interests of the local community.

4. Effect of Listing:
• Once an asset is listed as an ACV, the owner must inform the local authority if they intend to sell it.
• If the owner decides to sell, the community has a right to bid on the asset during a specified period. This period allows community groups to raise funds and put together a bid.

5. Right to Bid:
• The right to bid does not compel the community to purchase the asset, but it provides an opportunity for the community to express interest and potentially acquire the asset.

6. Impact on Planning:
• Listing as an ACV does not prevent the owner from selling the asset to whomever they choose, nor does it give the community the right of first refusal.
• However, the listing can influence the local planning process, as the community’s interest in the asset is taken into account.

7. Duration of Listing:
• An ACV listing typically lasts for five years, after which it can be renewed.

It’s important to note that ACV regulations and processes may vary slightly in different parts of the UK. Local authorities are responsible for managing the ACV process within their jurisdictions. If you are interested in a specific area, it would be advisable to check with the relevant local authority for the most accurate and up-to-date information.

The Branch actively supported the “Friends of the Gardeners” community group since 2021 and the fight continues. 

The final Appeal before a representative of the Secretary of State took place on Tuesday 12th December 2023 at Broxtowe Borough Council. Andrew Ludlow, Branch Secretary, spoke at the Appeal, which lasted from 10am until 3pm. He provided a thorough update on all of the local activity that has been undertaken and the justifiable need for the venue in the Community.

The decision will be given with 28 days of the Appeal, so we will provide an update on this at the January Branch Meeting.

Unfortunately the efforts to raise sufficient funds to take over the pub failed and the Friends of the Gardeners had to confirm in July that the fight was over. Please click on the following link for their update to local residents:
